Terms of Service

These Terms constitute a legally binding agreement between you and Doxa Technologies LLC, doing business as LightningApply (“Company”, “we”, “our”, or “us”), governing your access to and use of the LightningApply platform, website, and services (collectively, the “Service”).

By registering for an account, clicking “I agree”, or otherwise using the Service, you confirm that you are at least 16 years of age and have the legal capacity to enter into this agreement.

LightningApply is an AI-powered job application tool that helps users generate tailored resumes and cover letters from job postings. The Service allows you to:

• Create and maintain a professional profile, including importing details from an existing resume file or a photo or scan of one
• Submit job postings — by pasting text or providing a link — and receive AI-generated application documents
• Generate standalone resumes that are not tied to a specific job posting
• Edit, switch templates and themes, download, and email resume and cover letter PDFs — to yourself or to a recipient you choose
• Manage multiple job applications in one place
• Use additional AI-assisted features — such as interview preparation and answer coaching, offer negotiation guidance, profile and resume suggestions with an estimated applicant-tracking-system score, and job discovery — where available on your plan
• Subscribe to a plan, billed weekly or monthly, to generate documents on an ongoing basis

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We are not liable for any such changes.

To access most features, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your information as necessary
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access or security breach
• Accept responsibility for all activity that occurs under your account

You may not share your account credentials with others or create accounts on behalf of third parties without their express consent. We reserve the right to terminate accounts that violate these Terms.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Submit false, misleading, or fraudulent information
• Use the Service to create documents intended to misrepresent your qualifications
• Submit another person's personal information without their consent
• Use the document emailing feature to send unsolicited, bulk, or harassing messages, or to send a document to an address you have no legitimate reason to contact
• Create multiple accounts, or use alternate email addresses, to obtain additional free trials or referral rewards
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use automated bots, scrapers, or scripts to access the Service without written permission
• Transmit viruses, malware, or any harmful code
• Harass, abuse, or harm other users
• Use the Service in any way that violates applicable local, national, or international laws or regulations
• Resell or sublicense access to the Service without written authorization

We may suspend or terminate your account without notice if we determine, in our sole discretion, that you have violated these Terms.

Free Trial. New accounts start with a free trial that unlocks the Service's features for a limited time and a limited number of generated documents. When the trial ends, access to the Service's features requires an active membership.

One Trial Per Person. The free trial is offered once per person. We keep a minimal record of email addresses that have already used a trial, so deleting your account and registering again — or registering with a variation of an address that has already had one — will not start a new trial. We may change the length or limits of the trial, or withdraw it, at any time for accounts that have not yet started one.

Memberships. Memberships are billed on the recurring cycle shown for the plan you choose — currently weekly or monthly — and renew automatically until cancelled. Each plan grants access to the features it lists and either unlimited generated documents or a set allowance per billing period, as stated on the plan at the time you subscribe. You may cancel at any time from your account page; your benefits continue until the end of the billing period already paid for, after which the membership simply stops renewing.

Feature Availability. Some features — such as importing a job posting from a link, interview preparation, profile suggestions, and job discovery — are made available only on certain plans, and only while those features are enabled. Which features a plan includes may differ between plans and may change over time. We may add, modify, limit, suspend, or remove any feature at any time, including changing which plans include a given feature or turning a feature off entirely, and a feature being available at signup is not a guarantee that it will remain available. If we materially reduce the features included in your current plan, we will provide reasonable notice.

Top-Offs. Where a plan includes a set allowance of documents rather than unlimited documents, members who reach that allowance may purchase a one-time top-off for additional documents. Top-offs are not available on unlimited plans, which have no allowance to exhaust. Unused top-off documents carry over between billing periods and are non-refundable except where required by law.

Referral Rewards and Promotions. Where the referral program is available, inviting someone who then subscribes may earn a one-time credit toward a future payment for each of you, in the amount shown at the time of the invitation. Credits have no cash value, cannot be transferred or redeemed for cash, and apply only to a future payment on the account that earned them. Referral credits and promotional codes cannot be combined on the same purchase. We may modify, suspend, or end the referral program and any promotion at any time, and we may withhold or reverse a reward we believe was obtained through self-referral, duplicate accounts, or other abuse.

Complimentary and Beta Access. We may grant complimentary or beta access to the Service at our discretion. Such access is provided as a courtesy, may carry different limits than a paid plan, and may be changed or withdrawn at any time.

Refunds. Except where required by law, payments are non-refundable, and cancelling does not entitle you to a refund for the current billing period. Cancelling before a renewal date stops future charges.

Price Changes. We may change plan prices or the contents of a plan from time to time. Any price change applies to future billing periods, and we will give you advance notice of material changes.

Payment Processing. Payments are handled by a third-party payment processor, which is identified during checkout. By starting a membership or purchasing a top-off, you also agree to that processor's terms of service. We do not store your payment card details.

Your Content. You retain full ownership of the content you submit to LightningApply, including your profile information, job postings, and the AI-generated documents derived from your data. By using the Service, you grant us a limited, non-exclusive license to store, process, and display your content solely to operate and improve the Service.

AI-Generated Documents. The resumes and cover letters generated by the Service are based on your inputs and are created for your personal use. You own the generated output and may use it however you choose, including submitting it to employers — subject to your responsibility to review it first, described in Section 7.

Sending Documents to Others. The Service can email a generated document to an address you enter. When you do this, you are the one distributing your content: you are responsible for the address you enter, for having a legitimate reason to contact that recipient, and for the contents of the document you send. Once a message has been sent we cannot recall it.

Our Intellectual Property. All software, designs, trademarks, and content that are part of the LightningApply platform — excluding your content — are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works of our platform without written permission.

Feedback. If you provide feedback or suggestions, we may use them to improve the Service without any obligation to you.

The Service uses artificial intelligence to draft documents and generate guidance. AI systems can produce output that is inaccurate, incomplete, outdated, or entirely fabricated — including invented employers, job titles, dates, degrees, certifications, metrics, and accomplishments that you never provided, and rewordings that change the meaning of what you did provide.

You are responsible for reviewing and verifying everything the Service produces before you use it. Before submitting any generated resume, cover letter, or other document to an employer or any third party, you must read it in full and confirm that every statement in it is accurate, truthful, and not misleading about your experience, qualifications, credentials, or employment history. The Service is a drafting aid; it is not a substitute for your own review, and the output is not verified by us.

You are solely responsible for what you submit. Once you send a document, it is your representation about yourself, not ours. Submitting inaccurate or misleading information to an employer can have serious consequences — including withdrawn offers, termination of employment, and legal or professional liability — and you accept those risks. We are not responsible for any consequence arising from generated content you did not verify.

Guidance features are informational only. Interview preparation, answer coaching, offer negotiation guidance, profile and resume suggestions, and any score or rating we display are generated automatically for your consideration. They are estimates and general information, not legal, financial, tax, immigration, career, or employment advice, and they do not create any professional or advisory relationship between us. Compensation figures, market comparisons, and negotiation scripts may be inaccurate or unsuitable for your situation; consult a qualified professional before acting on anything that matters. Any applicant-tracking-system or match score we show is our own approximation and does not reflect how any particular employer's systems will read, rank, or handle your application.

Job postings and discovered listings. Job posting details fetched from a link, and listings surfaced by job discovery, come from third-party sources. They may be incomplete, out of date, duplicated, mis-categorized, or no longer open, and their presence in the Service is not an endorsement or a representation that a position exists or is available. Verify any listing with the employer before applying or relying on it.

No guarantee of results. We do not promise that using the Service will produce interviews, offers, employment, or any particular compensation outcome.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your information.

The Service integrates with third-party AI providers to generate documents and power its AI features, and with third-party providers for payment processing, hosting and file storage, email delivery, error monitoring, and retrieving job postings from a link. With your consent, we also use third-party advertising services to measure our marketing. These are described in our Privacy Policy. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the performance, accuracy, or actions of third-party services.

Links to third-party websites or services are provided for convenience only. We do not endorse or assume responsibility for any third-party content, products, or services.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• AI-generated documents, guidance, scores, or job listings will be accurate, complete, current, or suitable for any particular use
• Use of the Service will result in job interviews, offers, or employment
• Your documents or account data will not be lost, and that stored files will remain available beyond the retention periods described in our Privacy Policy — keep your own copies of anything you need
• Defects will be corrected

You use the Service at your own risk and, as set out in Section 7, are solely responsible for reviewing, editing, and verifying all AI-generated content before submitting it to employers or relying on it.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LIGHTNINGAPPLY, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless LightningApply and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your content, or your violation of these Terms.

You may stop using the Service at any time, and you may cancel your membership from your account page to prevent future charges.

We may terminate or suspend your account and access to the Service at our sole discretion, without notice or liability, for reasons including but not limited to violation of these Terms, fraudulent or illegal activity, or extended inactivity.

Sections 6, 7, 10, 11, 12, 14, and 15 survive termination of these Terms.

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. You agree that any dispute arising out of these Terms or your use of the Service will be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.

You waive any right to participate in a class-action lawsuit or class-wide arbitration against LightningApply.

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you via email or a prominent in-app notice at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance. If you do not agree to the revised Terms, you must discontinue use of the Service.
